Changes to TPS Haiti

A court ruled on July 15, 2025, that TPS Haiti cannot end earlier than February 3, 2026. This policy is in effect, but it could change. A ruling is expected by February 2, 2026, to clarify if TPS Haiti will remain valid while the court case is ongoing.

  • The TPS designation period remains 18 months due to a court order. Your benefits should remain valid through February 3, 2026.
  • If you already have TPS for Haiti under a previous designation, you must have re-registered by August 30, 2024 to continue your benefits through February 3, 2026.

The decision to end TPS for Haiti is still being challenged in court. The case is not finished yet. We do not know what will happen next. Learn how court decisions work.

January 28, 2026 update: A federal appeals court ruled that DHS acted unlawfully when it tried to shorten Haiti’s TPS period in 2024. This does not change the February 3, 2026, expiration date. Get updates on the status of TPS from the National TPS Alliance.

You can apply for work authorization by filing Form I-765 and paying the fee. It is recommended to apply at the same time you apply for TPS. Filing both forms together may help you get an EAD faster. You can also apply after.

If you apply for a new EAD during the current registration period, your work permit will be valid through February 3, 2026.

If you have TPS under a previous designation, USCIS has automatically extended the expiration date of EADs for TPS Haiti holders to February 3, 2026, for those whose EADs expired on the following dates:
