Temporary protected status for South Sudan was set to end on January 5, 2026. A court has temporarily stopped the termination of TPS South Sudan. Your TPS and work permit are still valid. You can no longer apply for or renew TPS South Sudan. Learn what this means and how to prepare.

TPS South Sudan changes

On December 30, 2026, a court temporarily paused the termination of TPS South Sudan. This means the case will continue to be reviewed in court.

Due to the pause, as of this date:

  • People from South Sudan with TPS still have this protection.
  • Work permits through TPS are still valid.
  • People with pending TPS applications have protection.
  • The pause will continue until the next court hearing.

Court cases on immigration policies can change the rules and be confusing. Read our guide on how court decisions work.

Work permits

If your TPS work permit (EAD) was set to expire on November 3, 2025, it is now automatically extended through January 5, 2026. You can keep using it as proof that you are allowed to work until there is a ruling in the court case.

What happens when TPS expires?

If you do not have another legal immigration status besides TPS, you will become undocumented and lose your work authorization. If you stay without legal status, you will risk being detained and deported.
