Temporary Protected Status (TPS) for Venezuela

TPS Venezuela has ended for most people. Certain people still have TPS or TPS work authorization based on documents they received on or before February 5, 2025.

What is TPS?

Temporary Protected Status (TPS) allows people from certain countries to stay and work in the U.S. if it is not safe for them to return home due to war, disasters, or other emergencies.

Is TPS for Venezuela still valid?

TPS Venezuela has ended for most people. The 2021 designation ended on November 7, 2025, and the 2023 designation ended on April 7, 2025.

However, if you received one of these documents on or before February 5, 2025, it remains valid under a court order:

  • A TPS approval notice or Form I-94 valid through October 2, 2026
  • An EAD valid through October 2, 2026
  • A Form I-797 receipt notice dated on or before February 5, 2025, extending an EAD that expired on September 10, 2025, or April 2, 2025, for up to 540 days. You can use this letter as proof with your employer.

There is a court case challenging the end of TPS Venezuela 2023.

Separately, the U.S. Supreme Court ruled that the government can move forward with ending TPS for Haiti and Syria. This ruling will likely affect the court case for TPS Venezuela 2023.

What happens when TPS expires?

If you do not have another legal immigration status besides TPS, you will become undocumented and lose your work authorization. If you stay without legal status, you will risk being detained, put in removal proceedings, and deported.
