Temporary Protected Status (TPS) for Venezuela
The 2023 designation for TPS Venezuela is ending. If you have TPS under this designation, you will lose benefits at the beginning of April 2025. If you have TPS through the 2021 designation, you will currently have benefits through September 10, 2025.
Changes to Venezuelan TPS
TPS allows people from certain countries to stay and work in the U.S. if it is not safe for them to return home due to war, disasters, or other emergencies. On February 1, 2025, the U.S. government announced changes to TPS for Venezuela.
2023 TPS designation
- The 2023 TPS designation for Venezuela is ending.
- If you had TPS and a work permit under the 2023 designation, your benefits will likely end in early April 2025.
- If you filed to re-register after January 17, 2025, your application will not be processed and your application fees will be refunded.
2021 TPS designation
- This program is closed to new applications.
- If you had TPS under the 2021 designation, your temporary protected status is until September 10, 2025.
- The January 2025 extension was canceled.
- The U.S. government will review the 2021 designation by July 12, 2025, to decide if it will continue or end. Be prepared for the possibility that it will end.
What happens when TPS expires?
If you do not have another legal immigration status besides TPS, you will become undocumented and lose your work authorization. If you stay without legal status, you will risk being detained and deported.
How to prepare
- Talk to an immigration lawyer. Find out your options for staying in the U.S.
- Apply for another immigration status if you qualify.
- You can have TPS at the same time as another immigration status.
- Review if you are eligible for asylum, lawful permanent status (Green Card), or other U.S. visas.
- Know your rights. Learn what to do if federal immigration officers or local law enforcement stop you.
- Plan for emergencies. Be ready for situations like detention, deportation, or sudden separation from loved ones.
- Be prepared for ICE. Know what to do if you are undocumented and agents come to your home or work.
- Stay informed. Learn more about immigration changes under the new administration.
Work permit
Work permits are available to people with TPS and are known as an Employment Authorization Document (EAD). You can apply for work authorization by filing Form I-765. It takes several months to get an EAD.
If you have TPS under the 2021 designation, your work permit (EAD) is automatically extended until March 10, 2025, if it is a category A12 or C19 under one of these expiration dates:
- March 10, 2024
- September 9, 2022
Travel permit
Travel permits are available to people with TPS. It is known as advanced parole. You can apply for a travel permit by filing Form I-131.
